Terms and Conditions for Unforgettable Adventures with Gomberi Travel

Welcome to Gomberi Travel, Your Gateway to Memorable Journeys in Tanzania and Zanzibar

As the Director of Gomberi Travel, I am committed to providing you with exceptional experiences, including thrilling hikes up Kilimanjaro, Meru, and Mount Kenya, captivating safaris to renowned Tanzanian parks such as Serengeti, Ngorongoro, and Tarangire, as well as exciting excursions in Zanzibar. To ensure your journey is seamless and enriching, please review the following terms and conditions, as they serve as the basis for your travel arrangements with us.

1.Booking Conditions

Upon confirming a booking with Gomberi Travel, you (the "Client") enter into a legally binding contract, agreeing to adhere to these terms and conditions. These conditions apply to all travelers included in your booking. In case of any disputes, resolution will be pursued through the United Republic of Tanzania – Moshi- court.

2. Price and Payment

Price Disclosure: Before confirming your booking, you will be informed of the current price for your chosen trip. This price is valid for 30 days and is subject to confirmation with a deposit payment.

Price Adjustments: Gomberi Travel will only seek to adjust the trip price in cases of "Price Force Majeure." This occurs when unforeseen increases in operational costs are imposed by relevant park or tourist authorities in the country where your trek operates (e.g., park entry fees or porter wages). In such instances, a surcharge may be added to the trip cost. If you choose not to proceed with the surcharge, you have the option to cancel the trip with a full refund. Failure to remit the surcharge by your arrival date may result in trip cancellation, accompanied by cancellation charges.

Deposit and Flexible Policy:

A non-refundable deposit, equivalent to 10% of the total trip cost or an agreed lower amount, is due upon booking. We understand that circumstances may change, so we've implemented a flexible policy. If you need to cancel your current trip, we'll hold the deposit for your next adventure with us. The remaining balance must be settled at least 2 weeks before your departure date in case of wire transfer, Credit card payment, and at least 1 day before the journey start day in case of Cash payment. Failure to meet the balance payment deadline may lead to booking cancellation and related charges.

No discounts will be granted for unused services if you decide, at the time of booking or prior to departure, not to participate in specific aspects of the planned itinerary.

3. Trip Changes

- Itinerary Flexibility: Our trips are dynamic in nature. While we aim to adhere to the itinerary as closely as possible, please understand that the day-to-day schedule and the ultimate trip objective are goals rather than strict contractual obligations.

- Unforeseen Circumstances: Gomberi Travel reserves the right to modify the itinerary at any time due to circumstances beyond our control, such as war, natural disasters, industrial disputes, terrorist activities, or other unforeseen circumstances (force majeure). In such cases, you may incur additional costs, and no compensation will be provided for unused services.

4.Delays on Internal Flights

Unpredictable adverse weather conditions at internal airports can occasionally disrupt internal flights, potentially causing delays in the commencement of your trek or climb. We strongly advise that your overall itinerary allows for some flexibility to accommodate such delays. Gomberi Travel assumes no responsibility for additional costs incurred as a result of these delays and does not offer compensation for unused portions of your trip.

5.Cancellation

- Gomberi Travel commits not to cancel your travel arrangements within 8 weeks of your departure date, except in cases involving force majeure, inadequate insurance coverage, or non-payment of the final balance. It is important to note that we are not liable for non-refundable costs incurred through self-booking of flights in the event we are compelled to cancel your trip for reasons other than those outlined.

- In the event of cancellation, we will provide compensation in accordance with the specified table. If we cannot fulfill the booked travel arrangements, you will have the option of a full refund or an alternative travel arrangement of similar standard, if available.

- Cancellation Charges:
  - Deposit and non-recoverable permit or park fee costs.
  - 56 - 30 days: 50% of the total trip cost and non-recoverable permit or park fee costs.
  - Less than 30 days: 100% of the total trip cost, including all permit or park fee costs.

6.In-country Assistance

Should the proper performance of our contract with you be compromised due to failures attributable to a third party unrelated to our services, unforeseen and extraordinary circumstances beyond our control, or events that could not have been foreseen or avoided even with due diligence, we will provide reasonable assistance as warranted by the situation.

7. Optional Activities

Any optional activities, excursions, or tours you book during the trip are not part of our services. Your contract for such activities is with the respective operator, not with us. We are not responsible for the provision of these activities or any incidents occurring during their provision.

8. Data Protection

Gomberi Travel takes responsibility for implementing proper security measures to protect your information. By making a booking, you consent to the sharing of your information with our suppliers, regardless of their location. This information may also be disclosed to public authorities such as customs or immigration, if required by them or as mandated by law.

9. Lost or Delayed Luggage

Occasionally, luggage may be lost or delayed by an airline, potentially causing significant disruption to your planned climb. To mitigate this, we recommend traveling in appropriate walking boots and carrying essential items in your carry-on luggage. If luggage is delayed, we will make every effort to assist you; however, any additional out-of-pocket costs must be incurred locally and subsequently claimed from your airline or insurers. This includes expenses related to taxi services for shopping or collecting items from the airport.

10. Our Liability

Many of our expeditions involve exposure to high altitudes, and they carry inherent risks such as altitude illness. Similarly, most trips visit remote or underdeveloped areas with limited infrastructure, which heightens health risks and reduces the capacity for effective injury or illness treatment. Furthermore, activities involving glacier terrain or snow-covered passes pose significant hazards, including the risk of severe injury or death. By accepting these booking conditions, you acknowledge these risks and confirm your acceptance of the associated dangers.

We will not be liable in cases where a failure in contract performance is due to the following:

- Your actions or those of a third party unrelated to trip provision, resulting in unforeseeable or unavoidable failures.
- Events of force majeure or other uncommon and unforeseeable circumstances beyond our control, whose consequences could not have been averted even with due care.
- An event that neither we nor our suppliers, despite exercising all due care, could predict or prevent.

Gomberi Travel will not be responsible for illness, injury, or death sustained during the trip unless directly caused by our negligence or the negligence of our employees. Nor will we be liable for uninsured loss of personal property. Your baggage and personal effects are at all times your own responsibility. We will not be liable for any loss, damage, or accidents involving luggage and property unless directly caused by us or one of our employees. We strongly recommend that you review your insurance policy's limitations in this regard.

Subject to the above, Gomberi Travel's liability arising from tort (including negligence), breach of contract, or other legal grounds will be capped at three times the price paid for your participation. Additionally, our liability may be limited in accordance with and/or similar to any relevant international Convention. These Conventions restrict the compensation you can claim for death, injury, passenger delay, and luggage loss, damage, or delay. Copies of these international Conventions are available upon request from our registered office.

Your Commitment to Us

1. Payment

To confirm your booking, you must submit a non-refundable deposit equivalent to 20% of the total cost per person for the climb. We recommend that you arrange any extensions, additional services, or extra accommodations at the time of your initial trip booking. Payment methods include bank transfer or check. Credit card payments may be accepted, but please note that a 5% bank charge will be applied to the invoiced amount for such transactions. In cases of payment originating from an overseas bank account, all associated charges must be borne by the transferor.

2. Group Volume Discounts on Private Trips

Group pricing discounts as stated in the booking are linked to group size. Any reduction in group size may result in an adjustment to the quoted price. All members of the group must travel together, and transfers will be organized for the entire group.

3. Group Coordinator Discounts on Private Trips

The Group Coordinator discount is contingent on the following:

- A single coordinator handling all group administration and payments.
- All group members traveling together, with transfers coordinated for the entire group.

4. Changes to Your Booking

While we typically accommodate booking changes at no extra cost, Gomberi Travel reserves the right to levy an administration fee of USD 50, plus any additional expenses incurred. Requests for changes must be submitted via email by the person who made the booking. Please be aware that the costs associated with altering a booking may increase the closer the change request is made to the departure date. Therefore, it is advisable to contact us as soon as possible in such instances.

5. Cancellation of Your Holiday

You, or any member of your party, may cancel your travel arrangements at any time. Cancellation must be communicated in writing by the person responsible for the booking. The applicable cancellation charges are outlined below. If your insurance policy covers the reason for cancellation, you may be eligible to recover these charges.

Amount of Cancellation Charge:

- More than 56 days: Deposit and non-recoverable permit or park fee costs.
- 56 - 30 days: 50% of the total trip cost and non-recoverable permit or park fee costs.
- Less than 30 days: 100% of the total trip cost, including all permit or park fee costs.

6. Lead Guide Authority

By signing our booking form, you affirm your commitment to respect the authority of the Lead Guide, who represents Gomberi Travel. The Lead Guide's decisions regarding tour conduct, itinerary, and objectives are considered final. If, in the Lead Guide's judgment, your behavior or physical condition poses a risk to safety, the welfare of you or any group member, or your overall well-being, you may be required to leave the tour without entitlement to a refund for unused services.

7. Your Responsibilities

Risks and Hazards

By booking, you acknowledge an understanding of and acceptance of the inherent risks and hazards associated with adventure trips. You confirm that you are mentally and physically capable of participating in your chosen trip.

Medical Conditions

It is your responsibility to disclose any existing medical conditions or disabilities that could impact your trip or the enjoyment of any member of your party before making a booking. If there is any doubt about the suitability of your medical condition or disability for the chosen expedition, you must seek medical advice to confirm that the trip is appropriate for your condition. By booking, you warrant that you have disclosed all relevant medical conditions and obtained any necessary medical advice affirming your fitness for the trip.

Proper Equipment

You are responsible for ensuring that you possess the appropriate clothing and equipment, as detailed in the "Plan your climb/trek" section on our website. If equipment rental is required, it must be promptly arranged as advised by our Lead Guide. Clients will not commence a climb/trek unless they have the requisite equipment, and no refunds or compensation will be provided in such cases.

8. Passports, Visas, and Immigration Requirements

Verification of your specific passport and visa requirements, as well as compliance with other immigration regulations, is your responsibility. We do not assume any liability for travel disruptions arising from non-compliance with these requirements.

9. Travel and Cancellation Insurance

Adequate insurance coverage for the entire duration of your trip is mandatory. Your insurance policy must include coverage for trekking to specified altitudes, medical expenses, injury, death, and the cost of repatriation and evacuation, including helicopter or air ambulance transport if necessary. In the event of emergency medical rescue or evacuation, you are responsible for the associated costs. Subsequent expenses, such as accommodations, food, and transportation, are also your responsibility. Failure to provide proof of adequate insurance coverage may result in booking cancellation. We recommend insurance providers such as Snowcard Insurance or Dog Tag, which specialize in mountain sports travel insurance and issue suitable policies for adventure travel trips.

10. Changes to the Itinerary

In the event that you are unable or opt not to complete a pre-defined itinerary for your trip, Gomberi Travel is not obligated to provide alternative itineraries, excursions, accommodations, services, or staff. We afford you the flexibility to modify your plans during the trip; however, no refunds will be issued for shortened trips, and Gomberi Travel will not reimburse additional costs incurred.

11. Complaints

If you encounter issues during your trip, please inform your Lead Guide promptly. The Lead Guide will make every effort to address your concerns. If your complaint cannot be resolved locally, please visit our primary office in Moshi-Arusha Rd, Moshi, Tanzania, within 7 days of your return from the trip. Provide your booking reference and all relevant details to expedite our response. We strongly recommend that you communicate any complaints to your tour Lead Guide without delay and complete a report form during the tour. Failure to adhere to this procedure may affect your rights under this contract.

12. Promotional Images

By participating in our trips, you grant Gomberi Travel permission to utilize any images or likenesses captured during the trip for promotional purposes across various media platforms, including brochures, websites, slideshows, video presentations, and the internet, without incurring any charges.
